Dr. Barry Brody: DIFFERENTIAL DIAGNOSIS OF THE THREE LEVELS OF PARENTAL ALIENATION SYNDROME

An interesting resource that might be worth circulating to the mental health community, including those associated with court services, is the Differential Diagnosis of the Three Levels of Parental Alienation Syndrome. Although the work refers to the syndrome, and there is an occasional dispute associated with the use of the term syndrome, there is little denying the reality that high conflict divorce and custody disputes are hard on children.

Whether you agree with the term syndrome or not, it has little bearing on the reality that children are often caught in the middle of parents' problems, especially when those problems boil into the courtrooms. One of the solutions identified is to remove many of the disputes from the courtroom and raising evidentiary standards while penalizing parents that are fighting through their children. It is essential to stop parents from dragging frivolous arguments into the court about the other parent. Let's face it, children thrive when they have access to both fit, willing, and caring parents and that means raising the bar and adjusting the system to "respect and protect parental rights" at both the parental level and the governmental level. Some interesting statistics regarding access to both parents can be found at http://www.childrenneedbothparents.net.

By implementing protections between parent's that want to abuse the court system and penalizing parents for bad behaviors we could make some strides in reducing the opportunity for parents to engage in high-conflict. Another such stride is mandating equal custody and equal parenting time for all fit, willing, and caring parents while penalizing those parents that refuse to cooperate with each other post-separation. "You don't have to like your co-workers and you are still able to do your job, especially when procedures ensure that cooperation" states Lary Holland of Family Court Reports.

"Dr. Brody is a licensed marriage and family therapist with over 35 years of experience in providing counseling services to individuals, couples, families, children and groups. Dr. Brody is a clinical member of the American Association for Marriage and Family Therapy. He has comprehensive training and experience in conducting child custody evaluations and has testified frequently as an expert witness in court on such issues as child custody, visitation, Parental Alienation Syndrome, domestic violence and abuse. Dr. Brody has been qualified as an expert in both state and federal court. He has also written two chapters for the recently published International Handbook of Parental Alienation Syndrome, and is recognized as an expert on Parental Alienation Syndrome."

"Dr. Brody specializes in treating marriage problems, domestic violence, relationship problems and children’s issues. He has also worked extensively with individuals in treating problems associated with relationships, parenting and life stressors. Dr. Brody’s therapeutic interests and community awareness led him to create Forensic Family Services with its mission of providing quality forensic and therapeutic services."

Michigan and the Nation have indeed lost a true warrior and a great
leader. We learned of this information early on Saturday morning, it took quite awhile to get over the shock of what had happened. This is another life-changing experience for me personally and we all need to take a moment and tell the ones that are important us, our friends, our family members that we love them and appreciate them. In essence, what we perceive as him leaving us, is God's way of letting us know that truly did succeed. He departs Earth
to be with his son, which tells us that he has planted all the necessary seeds to change society, we all now have to act on them and see them grow in his memory. Ron... we will miss you and we all will continue to love you!

Minister Ronald Smith and Lary Holland at the National Fatherhood Summit in 2007. When I return home during the week all pictures, video, and audio will be made accessible over the next several weeks to those that want to help spread the seeds of change and watch them grow in his memory.

From: http://www.ministersmith.com/content/view/26/34/

Minister Smith was born and raised in Chicago, Illinois. A product of the Chicago Public School system, furthered his education by attending and graduating from the University of Michigan at Dearborn. He further attended the Illinois Institute of Technology pursuing a degree in Public Administration.

Minister Smith has worked for the Mayor of the City of Chicago, and has also served as Assistant to the First Deputy Commissioner of the Department of Aviation for the City of Chicago. He has spent 15 years with the Community Mental Health Council as a Mental Health Professional and Psychiatric Rehabilitation Therapist under Dr. Carl C. Bell. During
this time, he also served as a Substitute Teacher in the Chicago Public School system.

Minister Smith is founder and CEO of Children Need Both Parent, Inc. which is a non profit 501(c)(3) based in Chicago, Illinois and Headquartering in Grand Rapids, Michigan. Children Need Both Parents, Inc. was founded in 1993 initially to assist non custodial parents to maintain an equal and positive relationship with their children. CNBP has since become an advocate of the American Family highlighting the importance of the protection of the parent child relationship.

Minister Smith is the father of two sons, Richmond E. Smith (deceased) and Ariel D. Smith. His sons were victims of Parental Alienation which has sparked his push for the elimination of these practices nationwide and spotlighted the need for shared parenting legislation to exist throughout this country. He is the author of the book Cheated (A Documented Account of Parental Alienation Syndrome) co-authored by his son Ariel.

Minister Smith dedicates his efforts to the memory of his son Richmond Elihu Smith who passed on April 27, 2007 from complications of liver cancer believed to be the result from the administration of Ritatlin.

"We will not stop until Shared Parenting is the norm, the senseless medication of our children has come to an end and the parent child relationship is protected at all cost." Minister Ronald E. Smith (2008)

Allegations Of Child Sexual Abuse In Divorce Cases: Responding To Criminal Charges

Allegations Of Child Sexual Abuse In Divorce Cases: Responding To Criminal Charges

Tawnya Maddox and Chrissy Chrzanowski were hosting a live talk show program on Friday August 29, 2008, known as SplitNTwo, with guest Dr. Reena Sommer. The topic was essentially how to handle false allegations of child sexual abuse in high-conflict divorce and custody cases. These issues have a significant relationship to Parental Alienation and Hostile Aggressive Parenting, where one parent attempts to sour the other parents relationship with their own children. Parental Alienation and using these tactics are also "child abuse."

Dr. Reena Sommer specializes in addressing issues pertaining to false allegations of child sexual abuse and also maintains several web resources like the website: Solutions4PAS

"A major thrust of Dr. Sommer's work is in the area of separation and divorce and assisting divorcing couples explore options in restructuring their lives. In the past, Dr. Sommer conducted court ordered custody evaluations and oversaw courted ordered supervised access. From time to time, Dr. Sommer is asked to provide expert testimony."

"Dr. Sommer is guided by the belief that children should not be denied a relationship with their parents simply because their moms and dads decide to divorce. She views her role as a family life consultant to help men and women develop effective parenting plans that make it possible for them to maintain a positive connection with their children."

I was able to pose a couple of questions, comments, but more importantly discovered an amazing resource for parents that suspect false allegations might come up from the other parent and shared it with those that were participating. I shared the resource below with Chrissy Chrzanowski, Tawnya Maddox, Dr. Amy Baker, Dr. Reena Sommer, and Katrina Daniels, whom I often refer to as the "Parental Alienation Task Force."

THE RESOURCE: DISTINGUISHING BETWEEN TRUE AND FALSE ALLEGATIONS OF CHILD SEXUAL ABUSE IN DIVORCE CASES: RESPONDING TO CRIMINAL CHARGES.

The article/study was authored Charles E. Bridges of Bridges, Nichols & Seibel. The link above is a repost of the original content at Delta Bravo, an affiliation of Separated Parenting Access & Resource Center (S.P.A.R.C.)

The introduction sets the tone of the piece:

"This article will focus on those procedures which may lead to false allegations of sexual abuse. By focusing on false allegations, I will be emphasizing what I believe are the weaknesses in the present system of identifying sexual abuse in children. My personal opinion is that the vast majority of sexual abuse allegations are true and that the dedication of the experts that I am critical of in this article has resulted in the conviction of sex offenders who might otherwise have gone free to abuse other children. So much deserved praise has been given these experts that I do not feel the need to say more. However, there has been so little deserved criticism of these experts that I do feel the need to criticize those procedures that can lead to false accusations of sexual abuse. False accusations can be devastating both to the innocently accused and to the child incorrectly diagnosed as a sexual abuse victim."

For anyone that might be facing the possibility of false allegations of child sexual abuse, know first and foremost that it is a very real threat and you could face jail time if the event is not handled correctly. It might not even be a bad idea to print out the report and pass it along or burn a copy of the talk show program "SplitNTwo" with Dr. Reena Sommer to a cd as a gift. Knowledge is power and making a mistake in handling false allegations can be devastating and cause the complete loss of your freedom and/or access to your children. No matter what, hang in there and share the information.

Mens Issues: Taking a more supportive approach, Guest Harry Crouch

Harry Crouch of National Coalition for Men (a/k/a National Coalition of Free Men) joined host Lary Holland on Get Off The Bench Wednesday August 27, 2008. The discussion was simple, Men's Issues and a new approach to balancing the equality equation.

It is well understood that the area of gender discrimination and gender issues have been widely distorted by propaganda and misdirected federally funded programs, but many advocates don't seem to want to address the very real issues associated with "Mens' Issues." To those that don't want to stand up and help balance the media distortions and quiety tip toe around such issues "To hell with them," states Harry Crouch. Simply put, Harry Crouch exposes several key areas in the above episode of Get Off The Bench.

Harry Crouch is the current president of the NCFM-SD (National Coalition for Men in San Diego) and delivered a power message on Get Off The Bench. I encourage all to listen and help spread the messages that Men's Issues are quite real and help balance the gender equation by objective advocacy. It's not about being "anti-woman" it is about being "pro... man." No simpler explanation can be used.

If you are unfamiliar with Men's Issues, you can visit the California Men's Center website or watch the video below about the subject. It is a thoughtful and well guided piece on Men's Rights/Issues. Let me know what you think about Men's Issues via email at getoffthebench@familycourtreports.com. I will air some comments on our next show.

Improved Adoption Incentives and Relative Guardianship Support Act of 2008

The Improved Adoption Incentives and Relative Guardianship Support Act of 2008, also known as Senate Bill 3038 has two significant changes that you just might need to know about. Some people are calling for the complete annihilation of the Title IV-E Program, which as some of you already know funds the Foster Care and Child Protective Services related programs in the various states.

The original reference to Title IV-E is under the Social Security Act. You can find the complete text located at the Social Security Website or under the US Code. (Begins: 42 U.S.C. 670)

Under the Improved Adoption Incentives and Relative Guardianship Support act of 2008, funding will be continued for the program but two notable changes are also be amended to the program. This is absolutely necessary, since it is what most would consider an essential services program. Some organizations are inadvertently calling for the non-renewal, but this is neither feasible or logical. The Federal government MUST continue to fund the state program under the contracts.

In the past, the federal government would only begin making payments to the states in the event that a child was taken and then placed with a licensed foster care facility. As you can imagine, the result was that the states wanted to be paid and would automatically place a child preferentially with a foster care facility instead of a stable relative guardian.

The first key change that occurs should S.3038 be passed, as it is anticipated to soon, the state would begin receiving payments if a child was taken and placed with a stable relative guardian. This will yield a reduction to the state foster care caseload and likely save every state money, allow for reduction of foster care caseloads, and have positive effects for the children involved. The more important factor is that a removed child will be able to continue living with relatives until the reason for the taking is cured.

Also in the past there was not a solid requirement to use electronic databases to locate the second parent that may not have any knowledge whatsoever that their child was removed from a single-parent home. Under the Improved Adoption Incentives and Relative Guardianship Support Act of 2008 there will be a requirement to utilize the Federal Parent Location databases to find the other parent for placement, again increasing the likelihood of a child being placed with a relative instead of sometimes hazardous state care.

There are other significant changes to the program, including an increase in funding, but the results of this bill are likely to cause each state to pass a statute that refers to payment for relative guardian placement. In the near future if your state does not pass such a statute, we can help provide model language to get the job done.

We need to be conscious of the positive and negative effects of large programs such as this and be sure to advocate responsibly. Sometimes when one is affected by a program that sometimes has extremely horrible effects on a family, it blinds us to the original goals of the programs. Taking a step back will help ensure maximum credibility for organizations and prevent the inadvertent destruction of programs that may serve legitimate needs. There is little question that more reform is necessary to the Title IV-E programs in our nation, but those changes must be identified and merged with existing renewal bills and more responsible advocacy.
